Lease was terminated 90 days after last day of production. Lease states that the equipment is to be removed but was abandoned on my land. Can I seize the equipment or does the company still lay claim on the equipment.

If it's still there after 90 days, I'd say you have a case to impound the items and charge exorbant storage fees and put a lien on the equipment. You'd better get the advice of a lawyer, though, to be sure. That'd be the best way.

I guess my question would be what steps have you taken to get the company to remove the equipment? If you have requested to them to remove all well head, pumping and distribution equipment and they have failed to do so, I would send them a certified registered letter stating your intent to invoke a land hold claim on all abandoned equipment on such and such a date. An attorney should really be doing this for you, since they will be familiar with land hold claims and abandoned equipment statutes in your jurisdiction. You may want to make sure that the abandoned well has been properly capped and that they don't leave you a several hundred foot deep hole that could cause you future liability as well. Good luck!

If it was on my property, I would see a lawyer, have him file notice of my intenet to seize within, say……..15 days from receipt of paperwork, & at that point I would take it if they didnt hadve the nads to come get within those 15.

Check the fine print ,, you can claim it Thu legal ways do it that way ,, or they can say you stole it and I think anything over 1,000 dollars is felony so be carefull ,,
Best to advertise it abandon and send them a letter stating that within 30 days upon receipt of your letter. that if the property is not claimed, you will hold it ,, for payment for storage ,, and post it in your paper ,,ck out your laws in your state REVISED STAUTES, Could be tricky if it is worth allot of money ,,
